Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh.  (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

Assalam aly kum,

Is it acceptable in ISLAM to marry a divorcee already having children but she cant give birth to any more children after the marraige and similar case regarding widows.

(There may be some grammatical and spelling errors in the above statement. The forum does not change anything from questions, comments and statements received from our readers for circulation in confidentiality.)

Answer:

Permissible to marry widow

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

The Messenger of Allah (saws) had eleven wives, and except for Hadrat Aisha (r.a.) and Hadrat Maimunah (r.a.), all his other wives were either widows or divorcees.

It is absolutely legal and permissible in Islam for a believer to seek to marry amongst the believing divorcees or widows, regardless of whether they have children or are childless, provided all the other conditions of marriage (being a non-mehram, mehr, witnesses, consent of the bride and her guardian, etc.) are met.

If the woman knows that she has a medical condition whereby she would be unable to have further children, it would be considered righteousness on her part to inform her condition to the man who seeks to marry her before their marriage. If the man, knowing her condition, accepts to marry her there is absolutely no harm and their marriage would be considered absolutely legal and acceptable in the sight of Islamic Law.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me. Allah Alone Knows Best and He is the Only Source of Strength.

Your Brother in Islam,

Burhan
