Chosing an imam for prayer

One of our brothers/sisters has asked
this question:

Bother,
Assalaam-O-Alaykum,
First of all a heartfelt thanks for your this kind worked, Allah ll give you
rewards. I have 3 question please give me answer in light of Quran and Hadith.
If possible please give answer in Urdu, because of we belong from Urdu dominant
location and its better for me to provide answer to persons in your written
words.
1) We can pray salaah (Namaaz) as mutadih (back of person) who is sodomise and
homosexual he is an Aaalim (Mualana) too. I mean we can make that kind of
person as Imam.
2) We can pray salaah (Namaaz) as a mutadih (back ho him) who is Waldozana
(wedlock). A person born from not married couple he born from biological
parents. we can make that kind person as a Imam. He is even Aalim (Mualana)
too.
In our location don`t allow to make an Imam above said persons.
3) We can marriage with wedlock person. If not then why what is mistake by
him/her. If any sin do by their parents then how can we boycott wedlock
persons. In our location don`t allow to marriage with him/her.
Please reply me brother as soon as possible. If any grammatically error then
please excuse.

Answer:
Chosing an imam for
prayer
In the name of Allah, We praise Him, seek His
help and ask for His forgiveness. Whoever Allah guides none can misguide,
and whoever He allows to fall astray, none can guide them aright. We bear
witness that there is none worthy of worship but Allah Alone, and we bear
witness that Muhammad (saws) is His slave-servant and the seal of His
Messengers.
Q-1: We can pray
salaah (Namaaz) as mutadih (back of person) who is sodomise and homosexual he
is an Aaalim (Mualana) too. I mean we can make that kind of person as Imam.
Sahih Al-Bukhari Hadith 5.595 Narrated by Amr bin Salama
That he heard the Prophet (saws) say: “Offer
such-and-such prayer at such-and-such time, and when the time for the prayer
becomes due, then one of you should pronounce the Adhan (for the prayer), and let the one amongst you who knows
Qur'an most to lead the prayer."
Sahih Al-Bukhari Hadith 1.653 Narrated by Malik bin Huwairth
We went to the Prophet (saws) and we were all
young men and stayed with him for about twenty nights. The Prophet (saws) was
very merciful. He (saws) said, "When you return home, impart religious
teachings to your families and tell them to offer perfectly such and such a
prayer at such and such a time and such and such a prayer at such and such a
time. And at the time of the prayer one of you should pronounce the Adhan, and
the oldest of you should lead the prayer."
When the believers gather to offer their congregational
prayers at a place of worship or the masjid, they should offer their prayers
behind the ‘imaam’ chosen and appointed by those in authority. But when the believers happen to assemble and
pray amongst themselves, the criteria for choosing the ‘imaam’ amongst them
should be the one who either knows the Quran more or is the oldest amongst them
in age.
Sunan of Abu-Dawood Hadith 2527 Narrated by Abu Hurayrah
The Prophet (saws) said: ‘Striving in the
path of Allah (jihad) is incumbent on you along with every ruler, whether he is
pious or impious; the prayer is obligatory on you behind every believer,
pious or impious, even if he commits grave sins; the (funeral) prayer
is incumbent upon every Muslim, pious and impious, even if he commits major
sins.’
If one is a known and unrepentant criminal (adulterer,
homosexual, sodomy, etc.), indeed it is the duty of the believers who are in
authority to not appoint such an evil-doer as the ‘imaam’ who leads the
believers in prayer.
But if for any reason such a person is indeed appointed by
the authority of the masjid to be the ‘imaam’, the prayer of the believers who
offer their prayers behind the ‘imaam’ would be considered valid.
2: We
can pray salaah (Namaaz) as a mutadih (back ho him) who is Waldozana (wedlock).
A person born from not married couple he born from biological parents. we can
make that kind person as a Imam. He is even Aalim (Mualana) too.
A child born out of wedlock is absolutely blameless and
innocent of the crime committed by its parents.
If one is indeed born out of wedlock, but is a pious God-fearing
believer, there is absolutely no harm in appointing such a person as the
‘imaam’ of the masjid or offering prayers behind him.
3: We
can marriage with wedlock person. If not then why what is mistake by him/her.
If any sin do by their parents then how can we boycott wedlock persons. In our
location don`t allow to marriage with
him/her.
We reiterate again that a child born out of wedlock is
absolutely blameless and innocent of the crime committed by its parents. Provided the person is a believer, there is
absolutely no harm in choosing or arranging to marry such a person.
Whatever written of Truth and benefit is only
due to Allah’s Assistance and Guidance, and whatever of error is of me
alone. Allah Alone Knows Best and He is
the Only Source of Strength.
