Can one marry insane / schizophrenic

Mu' meneen Brothers and Sisters,

One of our brothers/sisters has asked this question:

Answer:

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

If the person marrying the schizophrenic or mentally unstable is completely aware of the condition of his/her suitor, and still chooses and agrees to marry him/her of their own free will, there is absolutely no harm or restriction in Shariah regarding such a marriage. 

 

Because the marriage is an agreement between two people, the ‘mentally unstable’ person must at the least be able to understand the implications and conditions of the marriage agreement.  If the person is absolutely crazy and cannot determine between right and wrong in the least, or does not understand the duties or responsibilities of what an agreement to the marriage would lay upon him/her, it would not be right for one to marry such a person.

 

In any case, if one does marry such a person provided all the conditions of an Islamic ‘nikaah’ are honored, the marriage will be accepted as legal and valid in the sight of Shariah.
