One of our brothers/sisters has asked this question:

 

Dear Brother Burhan,

 

One of our Sister in Islam had asked some questions to you, ref Question : 1269.

 

Following is one of the questions she asked you:

 

"My husband although turned to Bohra does not pray etc. He just did all that because the Bohras forced him to and so that I could attend mosques etc.. Infact I think partly it is only the Bohras to blame for him being a bit negative about Islam since he had to lick a lot of  shit from them and nobody wants to be subjugated to humiliation.  Is that right??"

 

My intention here is not to hurt anybody's feelings (Allah Subhanah knows better).

 

My question: If a Muslim girl marries a non-muslim and if her Husband has not accepted the deen (Islam) Is she is a Muslim? Because after having Husband-wife relations can she be called as a Muslim?

Answer:

 

If muslim woman marries mushrik

In the name of Allah, We praise Him, seek His help and ask for His  forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad(saws) is His slave-servant and the seal of His Messengers.

 

According to the letter of the sister, she had married a person who was born in the Jain religion, but subsequently he declared the testimony of faith or ‘shahaadah’ and became a muslim. Anyone who declares the testimony of faith verbally that there is no god except Allah Alone, and Mohamed (saws) is His Messenger; he will be deemed a legal muslim and all the rights that are due to a muslim shall be accorded to him in full.

 

Whether or not the person really accepted Islam as his way of life, or he simply uttered the ‘shahaadah’ to marry the woman is knowledge known to the person who declared the shahaadah and Allah Subhanah! We have not been give the right by Allah Subhanah to determine whether he declared the ‘shahaadah’ for worldly reasons, or because he truly believed in Islam. The decision whether he was truly a muslim will be made by Allah Subhanah Alone on the Day of Judgement. If one declares the ‘shahadaah’, he will be treated by the muslims as their brother in faith, and all the rights that are due to a muslim shall be accorded to him in full.

 

If a believing woman knowingly marries a mushrik, she will be committing a heinous sin in the sight of Allah; but she will still remain a muslim unless she voluntary denounces her religion. Her marriage with the mushrik person will not be recognized by Shariah; and her marriage will be considered null and void in Islam.

 

After one has declared his/her faith in Islam and announced the testimony of faith; no person has a right to declare them non-muslims, no matter what they do.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me. Allah Alone Knows Best and He is the Only Source of Strength.
