Dear Brother,
Please help one of my friend's problem in spirit of
Quran & Hadith.
He perform a Haj few years ago that time he was
un-married now he is married and had kids while stone throwing in Jimrat
he was in plunge of performers as well as men and women during this
rush hour accidentally without any intention he get very closer a women
and he loose his control..... pls understand. After that he get bath and
completed all others arkan of hajj. ( All above matter is word to word by
my friend ).
In this situation till dated he is very shameful
and and couldn't speaks this matter with any one. Now he want to perform hajj
along with his wife.
Please kindly advice him what shall Kuffara or Dam he
must do.

In the name of Allah,
We praise Him, seek His help and ask for His forgiveness. Whoever Allah
guides none can misguide, and whoever He allows to fall astray, none can guide
them aright. We bear witness that there is none worthy of worship but Allah
Alone, and we bear witness that Muhammad (saws) is His slave-servant and the
seal of His Messengers.
If one who is performing the
pilgrimage of Hajj and has sexual intercourse or intentionally releases his
‘mani’ or sperm during the prescribed Hajj days, one would have deemed to have
violated one of the prohibition of the pilgrimage and an atonement of a
sacrifice would indeed be due from such a person.
But if one unintentionally or
accidentally in the process of performing the Hajj pilgrimage lost control of
his emotions and reached an orgasm whereby ‘mani’ was actually released from
his private parts during the prescribed Hajj days….although his Hajj pilgrimage
would be considered valid, what happened was indeed a sin and one must seek
sincere repentance from their Lord for their error.
Because the sin committed was
unintentional and accidental, the majority of the scholars are of the opinion
that although a sacrifice is not due as atonement, it would be prudent that the
person offers a sacrifice as atonement and seeks sincere forgiveness from Allah
Subhanah for his error….it is expected that he will find his Lord Forgiving and
Merciful, Insha Allah.
Whatever written of
Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever
of error is of me alone. Allah Alone
Knows Best and He is the Only Source of Strength.
