Dear
Brother As salam alaikum,Kindly tell me in the light of Quran and Sunnah,what
if One Person leaves for muzdalifah on the 9th of dhul hijjah from arafah after
sunset in buses but is prevented(due to large traffic jams) from reaching
muzdalifah before midnight rather he reaches there just fifteen to twenty minutes
before the azan for salaatul fajr is called.Is his Hajj valid,does he owe any
fidya and if he does then what if he has returned back to his
homeland?Jazakallah

In the name of Allah, We praise Him, seek His
help and ask for His forgiveness. Whoever Allah guides none can misguide,
and whoever He allows to fall astray, none can guide them aright. We bear
witness that there is none worthy of worship but Allah Alone, and we bear
witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.
Allah Says in the Holy Quran Chapter 2 Surah
Baqarah verses 198-199:
198 ….Then when ye pour down from Arafah celebrate the praises of Allah at
the ‘Mashaeral Haraam’ (Muzdalifah), and celebrate His
Praises as He has directed you, even though before this ye went astray.
199 Then pass on at a quick pace from the place whence it is usual for
the multitude to do so, and ask for Allah's forgiveness. For Allah is Oft Forgiving Most Merciful.
Indeed to depart from the plains of Arafah after sunset on
the 9th of Dhul Hijjah and reaching ‘Muzdalifah’ is from amongst the
obligatory rites of the pilgrimage of Hajj.
Respected brother, the roads from Arafah to Muna are such
that one has to cross through the halting station of ‘Muzdalifah’; thus if you
left Arafah after sunset towards ‘Muzdalifah’, even if you were sitting in the
vehicle stuck in traffic, chances are that you would have already entered
‘Muzdalifah’, which would suffice to fulfill the rite of being in
‘Muzdalifah’. Besides, if for a genuine
reason like heavy traffic, you were able to reach ‘Muzdalifah’ only moments
before ‘Fajr’, the absolute majority of the scholars and jurists in Islam are
of the opinion that that too would suffice to fulfill the obligatory rite of
reaching ‘Muzdalifah’.
Thus brother, rest absolutely assured that your Hajj is
valid and there is absolutely no ‘kaffarah’ or atonement due from you.
Whatever written of Truth and benefit is only
due to Allah’s Assistance and Guidance, and whatever of error is of me
alone. Allah Alone Knows Best and He is
the Only Source of Strength.
