A person for the name sake he is muslim who has a habit of driking Alcohol and
disturbing his wife, children and whole family. Drinking alcohol is haram and
big sin. The relationship what he shares with his wife is jayaz? Please answer
me according to Islamic point of view according to Quran and sunnah.

Answer:
Abusive husband
In the name of Allah, We praise Him, seek His help and ask
for His forgiveness. Whoever Allah guides none can misguide, and whoever
He allows to fall astray, none can guide them aright. We bear witness that
there is none worthy of worship but Allah Alone, and we bear witness that
Muhammad (saws) is His slave-servant and the seal of His Messengers.
Sunan of Abu-Dawood Hadith 2526 Narrated by Anas ibn Malik
The Prophet (saws) said: “Three things are
the roots of faith:
- to
refrain from (killing) a person who utters, "There is no god but
Allah", and
- not
to declare him unbeliever whatever sin he commits, and
- not to excommunicate him from Islam for his any actions.”
Dear and beloved brother in Islam, as long as one
professes and declares belief in the Supreme Oneness of Allah Subhanah, and in
the appointment of Prophet Mohamed (saws) as the Last and Final Messenger of
Allah (saws)…..regardless of his actions, sins, or (mis)deeds, he will be a
legal muslim in the Sight of Shariah Law; and every right that is due to a
muslim will be accorded to him in full. It is only the All-Knowing, All-Wise, All-Just Lord Who Alone will
determine on the Day of Judgment whether or not each individual who claimed to
be a muslim was truly a believer or not.
Thus if one claims to be a muslim, declares his belief in
Allah and His Last Messenger (saws); but unfortunately does not fear his Lord
Creator and is involved in a plethora of sins like alcohol abuse, abuse of his
wife and family, etc…..the sins, as grave and great as they may be, do not by
themselves render the person a disbeliever in the Sight of Shariah Law! The person will remain a muslim unless and
until he himself, without any force or coercion, of his own free will declares
himself to be a disbeliever.
The abused wife in such a situation has two lawful
options:
- If
she sincerely believes that her husband has the tendency and may one day
fear the Tribunal of his Lord, repent for his deeds and amend his conduct,
she may opt to be patient, bear the abuse, and wait for her day to receive
retribution and justice in the Court of Allah Subhanah….and thus save her
marriage.
- But
if she does not believe that her husband will repent and amend his
conduct, she is well within her rights to initiate a divorce proceedings
against such an evil husband, and there will be absolutely no blame or sin
upon her.
But at long as the wife chooses to remain married,
regardless of whether her husband honors and fulfills his rights towards her in
marriage; she as a believer must fear Allah and strive to fulfill all her
duties and responsibilities towards her husband in full…..and seek her
retribution and rewards for the injustice done towards her by her husband in
the Just and Supreme Court of the Lord Most High on that Inevitable Day of
Judgment where no doer of good will go unrewarded, and no doer of evil will go
unquestioned!
Whatever written of Truth and benefit is only due to
Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only
Source of Strength.
