Aslam Alaikum,
I`d like to ask that if a boy and girl accept each other as a husband and wife
i;e they say "Qabool Hai" three time as to be said in Nikkah. Are
there Nikkah done by this act? I have
heard this in some islamic programe on tv. i am really confused ,please reply
soon.. I will be waiting for your reply.

Answer:
Verbal Acceptance of Marriage
In the
name of Allah, We praise Him, seek His help and ask for His forgiveness.
Whoever Allah guides none can misguide, and whoever He allows to fall astray,
none can guide them aright. We bear witness that there is no one (no idol, no
person, no grave, no prophet, no imam,
no dai, nobody!) worthy of
worship but Allah Alone, and we bear witness that Muhammad (saws) is His
slave-servant and the seal of His Messengers.
In light of the teachings of the Quran and the Sunnah, the following acts are considered absolutely obligatory conditions of a marriage or ‘nikaah’ contract:
- The
proposal by the groom and the acceptance by the bride
- The
determination of the ‘mehr’ gift for the bride
- The
presence of (at least) two witnesses to the ‘nikaah’ contract
- The
presence and consent of the guardian or ‘wali’ of the bride.
There is
a difference of opinion amongst the scholars in Islam whether the ‘consent of
the wali’ is an obligatory condition of Islamic Nikaah or not; but all the
scholars of all the schools of thought are absolutely anonymous regarding the
obligations of the first three conditions.
Any
marriage between two eligible persons which satisfy and fulfill the above
obligatory conditions of Shariah will be deemed legal and valid in the Sight of
Allah Subhanah and Shariah.
Any
marriage which does not satisfy even one of the above obligatory conditions of
Islamic marriage will be deemed null and void in the Sight of Allah Subhanah
and Shariah.
Your Question: I`d
like to ask that if a boy and girl accept each other as a husband and wife i;e
they say "Qabool Hai" three time as to be said in Nikkah. Are there
Nikkah done by this act?
If the
boy and the girl have between themselves simply declared ‘Qabool Hai’ (I accept
you), without the determination of mehr and the presence of at least two
witnesses and the bride’s guardian; the Nikaah would be deemed absolutely
illegal, null and void in the Sight of Allah Subhanah and Shariah.
Whatever
written of Truth and benefit is only due to Allah’s Assistance and Guidance,
and whatever of error is of me alone.
