Salaam, First of all I wanna congrajulate n thank u for making an effort of solving queries of muslim brothers n sisters. These days there are times wen we r doubtful abt our acts whether they r right or wrong due to lack of knowledge. Few days back when I was discussing abt sins with my frnds, one of them told me that zina means rape, n if man n woman agrees to sex(without being married), it is not zina n there is punishment for that but not as severe as zina, plz let me know whether its correct or not. I also wanna know the difference between adultery n fornication. If a boy n a girl love each other n they wanna marry, n if their families refuse, wat should they do? They love each other n find it difficult to sacrifice their love for their families n on the other side they dont wanna go against their parents wish, in such a case what ll u advise them to do? plz answer it as soon as u can coz its quite urgent.

Difference between Zina and Rape

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Allah Says in the Holy Quran Chapter 24 Surah Noor verse 2:

2 The woman and the man guilty of ‘zina’ (fornication) flog each of them with a hundred stripes: let not compassion move you in their case in a matter prescribed by Allah if ye believe in Allah and the Last Day: and let a party of the believers witness their punishment.

 

Regardless of whether it is consensual or non-consensual, any sexual intercourse between a man and a woman who are not united in the sacred bond of marriage is termed as ‘zina’ in Shariah terminology.

 

If one is unmarried and commits the crime of ‘zina’ (fornication), regardless of whether it is consensual or not, the prescribed punishment in Shariah Law is a 100 lashes in public.

 

If the one who committed the heinous crime of rape also committed other crimes in addition to the evil of rape, like he abducted the victim, or used arms or ammunition to subdue the victim, or physically hurt or injured the victim, etc., then the prescribed punishments for those crimes will be added to the prescribed punishment of 100 lashes of zina.

 

The above is only the prescribed punishment Shariah or Islamic Law allows the righteous society or Islamic State to exact retribution from the criminal in the life of this world. If the person who committed this evil and heinous crime does not repent for their sins, the punishment in the Hereafter in the Presence of the Majestic Lord would be much more severe and ever-lasting!

 

Your Question: I also wanna know the difference between adultery n fornication.

If one is married and has sexual intercourse with any other woman than his lawfully wedded spouse, it will be deemed adultery…and the prescribed punishment for adultery in Islam is to stone the convict to death in public.

 

If one is unmarried and has sexual intercourse, it will be deemed fornication…the prescribed punishment for which in Shariah is a 100 lashes in public.

Dear and Beloved Sister, love-hate, like-dislike, joy-sorrow, smile-weep, etc. are natural emotions of mankind! What determines virtue and sin is what one says or does when one experiences these natural emotions!

 

To love someone is a natural emotion, and there is absolutely no sin if one loves another person; it is what done does after one has fallen in love with that person which would determine whether it would be counted as a virtue and a good deed in the Sight of Allah or a sin!

 

If one falls in love, and informs one’s guardians that they love so and so, and requests them to sanctify their love in the sacred bond of marriage so that they may love each other for the rest of their lives would be counted as a virtue and a good deed in the Sight of Allah Subhanah.

 

But if one falls in love, and strives to meet the person in secret and in private, and in their love transgress the boundaries of Allah Subhanah before they are united in the sacred bond of marriage; then indeed it would constitute a huge sin in the Sight of Allah Subhanah.

 

Thus falling in love with a member of the opposite sex is not a sin by itself; what one does after one has fallen in love determines whether it is a virtue or a sin in Islam.

If for some reason the guardians disagree with their choice, it would be best to with extreme wisdom, patience and politeness try to convince them to agree and consent to their choice. But if for some reason they are not able to convince their guardians to agree to their choice in marriage, it would be righteousness and piety to sacrifice their love for the sake of their parents and marry someone else who is agreeable to both, themselves and their parents; for Islam guides that none in creation is a better well-wisher than one’s own parents.

 

Al-Tirmidhi Hadith 4928 Narrated by Abud Darda

When a man came to him and said, "I have a wife whom my mother commands me to divorce," he replied to him that he had heard Allah's Messenger (saws) say, "A parent is the best of the gates of Paradise; so if you wish, keep to the gate, or lose it."

 

If one trusts, obeys, and follows the guidance and commands of Allah and His Messenger (saws), one can be assured of never ever being misled; but if one believes, obeys and follows any other guidance, other than that of Allah and His Messenger (saws), one can be assured of being led astray.
