One of our brothers/sisters has asked this question:

Asslamualaikum,

My mother's sister had breast feed my elder brother who got married to her(Mother's sister's) daughter (Cousin).


Will this marriage will be approved? is there any kuffarah for this? please guide me in the loght of Quran & Hadith.

Answer:

 

Marry foster sister

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Al-Muwatta Hadith 30.4

Yahya related from Malik from Thawr ibn Zayd ad-Dili that Abdullah ibn Abbas (r.a.) said, "The milk which a child under two years old sucks, even if it is only one suck, makes the foster relatives ‘haram’ (sacred)."

 

Sahih Al-Bukhari Hadith 7.36 Narrated by Aisha

The Messenger of Allah (saws) said: “Foster suckling relations make all those things ‘haraam’ (sacred) which are ‘haraam’ through corresponding birth (blood) relations."

 

If your mother’s sister suckled your brother, then your brother would be considered a ‘mehram’ to all the biological daughters of your mother’s sister in the Sight of Shariah Law….and as such, it would be absolutely unlawful and illegal for your brother to marry the daughters of your mother’s sister.

 

Even if such a marriage were to take place, the marriage will be considered illegal, unlawful, null, and void and in the Sight of Shariah Law, in the Sight of Allah Subhanah, and in the sight of the believers.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
