Dear Brother,

As my husband get married second time without telling me, i asked for divorce, after like 2 years of my marrige this happened. Also the relations between us was not so understanding n good. after his second marrige he send me divoce papers twice, in which hi has written and at the end signed for divorce and send me twice. now its more then year. so is it ok if i marry another guy. like our divorce is ok. after receiving that divorce paper , i never talk to him. please let me know.

Divorced woman marry again

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Allah Says in the Holy Quran Chapter 2 Surah Baqarah verse 229 (part):

231 When ye divorce women and they fulfil the term of their (`Iddat) either take them back on equitable terms or set them free on equitable terms; but do not take them back to injure them or to take undue advantage; if anyone does that He wrongs his own soul. Do not treat Allah's Signs as a jest but solemnly rehearse Allah's favors on you and the fact that He sent down to you the Book and Wisdom for your instruction. And fear Allah and know that Allah is well acquainted with all things.

The husband in every marriage in Islam has three divorce rights, the first two of which are revocable, and the third is absolutely irrevocable.

If the husband were to pronounce the first and/or the second divorce to his wife in the marriage, regardless of whether it is verbal, on the phone, or in writing, etc…..the wife is commanded by Shariah Law to observe an ‘iddah’ or a waiting period of three menstruations. If before the expiration of the ‘iddah’ period, the husband wishes to revoke the divorce, he is well within his rights to do. But if the ‘iddah’ period of three menstruation period expires, the divorce will be deemed established in the Sight of Shariah Law, the husband and the wife become non-mehrams to each other, and the wife is absolutely free to marry anyone she wills and pleases after her waiting period or ‘iddah’.

Dear and beloved Sister, if your husband has sent you a written notice of divorce, and he has not revoked the divorce before the period of three menstruations have elapsed….a divorce between you and your husband would indeed be deemed as established in the Sight of Shariah Law and of Allah Subhanah; and you are at absolute liberty and well within your rights in Islam to seek to marry another eligible believer of your choice.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
