Ejaculation during Ramadan

One of our brothers/sisters has asked this question:

Dear Sir/Madam,

 

During the month of Ramadan, during the day time when i was fasting, i indulged in an intimate encounter with my female friend.

 

There was NO INTERCOURSE.. MY PENIS DID NOT PENETRATE HER VAGINA

She made me ejaculate using her hands, and i made her ejaculate using my fingers
I want to know:


1) Is my fast broken?
2) If yes, what should i do to compensate for it?
3) Do i have to fast for 60 consecutive days or can i feed 60 poor people?

Answer:

 

Ejaculation during Ramadan

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Q-1) Is my fast broken?

If orgasm was reached which resulted in ejaculation, indeed it would break and invalidate the fast.

 

Q-2) If yes, what should i do to compensate for it?

As grave and as heinous the sin of forming an illicit relationship out of marriage is in the Sight of the Lord, and as grave and as heinous the sin of actually performing a sexual act between two unmarried persons of the opposite sex is in the Sight of the Lord, and as grave and as heinous the sin of performing such an unlawful act while fasting in the Holy Month of Ramadan might be in the Sight of the Lord……because there was no actual penetration of the male organ into the female organ, but rather an orgasm was reached which resulted in ejaculation, the ‘kaffarah’ or atonement is to sincerely seek the forgiveness of Allah and make up the missed fast by fasting another day of the year.

 

Q-3) Do i have to fast for 60 consecutive days or can i feed 60 poor people?

Abu Hurairah reported that a man came to the Messenger of Allah (saws) and said: "I am destroyed, O Messenger of Allah (saws)!" The Prophet (saws) asked: "What has destroyed you?" He said, "I had intercourse with my wife during a day of Ramadan." The Prophet (saws) asked: "Are you able to free a slave?" He said, "No". The Prophet (saws) asked: "Is it possible for you to fast for two consecutive months?" He said, "No." The Prophet (saws) asked: "Is it possible for you to feed sixty poor people?" He said, "No." The Prophet (saws) said: "Then sit." A basket of dates was brought to the Prophet (saws) and he said to the man: ‘Give this in charity.’ The man said: "To someone poorer than us? There is no one in this city who is poorer than us!" The Prophet (saws) laughed until his molar teeth could be seen and said: "Go and feed your family with it!"

If the male organ had entered the female organ, or even as so much as touched it, then indeed you would be required to atone for the transgression by fasting for two consecutive months or feeding sixty poor people. But since there was no penetration, the scholars and the jurists in Islam are unanimous in their opinion that the act does not constitute sex…..thus the seeking of sincere repentance and making up for the broken fast by fasting on any other day of the year would suffice.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
