Selling visas
Mu' meneen Brothers and Sisters,
As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's
Peace, Mercy and Blessings be upon all of you)
One of our brothers/sisters has asked this question:
aslam o alikum
my brother established an office of recruting agency. he purchased
visas from different countries and sell them to people. my
question is this that he purchase visas from construction company but he tells
the people that u would not work in this company. i will promise u that u will enter that country only.
this company will not give u job. and important thing
is this the said company also knows what will be happen in other meaning the
said company takes money from my brother for issuing visas. my
brother collects money from different people to send them abroad. he also pays some money to higher officers of pakistani govt. he has licence
for sending people to abroad for working. but he has
to pay money to said construction company and as well as to paksitani
govt afficers also. now he wants that i join his
office. tell me according to islamic
law may i join or no. he will pay me salary per
month.

Answer:
Selling
visas
In the
name of Allah, We praise Him, seek His help and ask for His forgiveness.
Whoever Allah guides none can misguide, and whoever He allows to fall astray,
none can guide them aright. We bear witness that there is no one (no idol, no
person, no grave, no prophet, no imam,
no dai, nobody!) worthy of
worship but Allah Alone, and we bear witness that Muhammad(saws) is His
slave-servant and the seal of His Messengers.
Firstly, it is of paramount importance that no lies are told. If the company clearly tells the people that the visa is only for entry into the country and from then onwards they are on their own; there is absolutely no harm in such a transaction.
To the
best of our knowledge, it seems that in most countries, especially the Middle
Eastern nations, the authorities issue visas to a company on the pretext that
the people being brought in can only be employed by the company on whose name
the visas were issued, and it would be illegal and punishable by law if the
person works anywhere else other than the company. In such cases it would not be legal for one
to buy and sell these specifically issued visas, nor would it be considered
righteous nor behove a believer to assist someone in breaking the legal laws of
a country.
Whatever written of Truth and benefit is only
due to Allah’s Assistance and Guidance, and whatever of error is of me. Allah Alone Knows Best and He is the Only
Source of Strength.
Your Brother in Islam,
Burhan
