As far as india is concern people who are working in banks out there

save there side by saying that we are living in a country where we have to
pay Taxs on diffrent things. So that also is forbiddien in islam to pay any
of the taxes so if we are paying taxes we can also take Interest. It seems
to be they are compansating it.

Answer:

Paying Tax

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Firstly brother, the payment of government levied taxes in a nation has to do with legalities of living in that particular nation; and if one does not pay them as demanded by the concerned government, one would be liable for legal prosecution according to the laws of that nation. Payment or non-payment of the government levied taxes is associated with the laws of this world, and nothing to do with the laws of Islam.

Just because one is compelled to pay the worldly government levied taxes, it does not make it legal for the person to consume ‘interest’, which is clearly forbidden by Allah and His Messenger (saws)! One has got nothing to do with the other!

The people who have made it legal for themselves to consume interest just because they are compelled to pay worldly taxes to live and work in a nation are obviously in clear error! Allah and His Messenger (saws) have clearly declared the consumption of ‘interest’ haraam, and no one has a right to declare legal what Allah and His Messenger (saws) have declared illegal!

Secondly, just because someone has done some excess towards a person, that person has no right to transgress the Laws of Allah or commit excess against another! Just as it would not be legal for a person to transgress the Laws of Allah and cheat someone simply because he was cheated by another, or just as it would not be legal for one to transgress the Laws of Allah and accept a bribe simply because he was forced to bribe another, or just as it would not be legal for a person to transgress the Laws of Allah and have illegal sexual intercourse with another’s sister just because someone had illegal sexual intercourse with his sister… it would not be legal for one to pay taxes of the world and compensate himself by transgressing the Laws of Allah and consuming the interest, which has been clearly described as forbidden and haraam by Allah and His Messenger (saws)!

Allah says further in the Holy Quran Chapter 2 Surah Baqarah verse 278:

O Believers!, Fear Allah and give up that ‘riba’ which is still due to you, if you are true believers. But if you do not do so, then you are warned of the declaration of war against you by Allah and His Messenger!

Allah says in the Holy Quran Chapter 4 Surah Nisa verse 161:

That they took ‘riba’, although they were forbidden. And that they devoured men’s substance wrongfully. We have prepared for those among them who reject faith a grievous punishment (of Hell Fire)!

Allah says in the Holy Quran Chapter 2 Surah Baqarah verse 274-276:

But those who devour ‘riba’ become like the one whom Shaitaan has bewitched and maddened by his touch. They have been condemned to this condition because they say, “Trade is just like ‘riba”, whereas Allah has made trade halaal and ‘riba’ haraam. Henceforth, if one abstains from taking ‘riba’ after receiving this admonition from his Lord, no legal action shall be taken against him regarding the ‘riba’ he had devoured before: his case shall ultimately go to Allah. But if one repeats the same crime even after this, he shall go to Hell, where he shall abide for ever! Allah deprives ‘riba’ of all blessing and develops deeds of charity, and Allah does not like an ungrateful, sinful person.

Allah Subhanah has clearly declared the consumption of interest as absolutely haraam and forbidden for the believers; and none has the right to declare permissible what Allah and His Messenger (saws) have declared forbidden in Islam.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and sincere well wisher in Islam,

Burhan
