What is `kafar`aa for Talaaq

Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh.  (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

what is `kafar`aa for Talaaq

(There may be some grammatical and spelling errors in the above statement. The forum does not change anything from questions, comments and statements received from our readers for circulation in confidentiality.)

Answer:

What is kaffara atonement for talaq divorce

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Dear and Beloved Sister, a ‘kaffarah’ or atonement in Shariah Law and Islamic Jurisprudence or Fiqh is only applied if one has omitted an obligatory duty, committed a sin, or transgressed the prescribed boundaries of Allah Subhanah.

To give a divorce, in its very essence, is neither a sin nor prohibited nor unlawful in Islam; thus there can be no ‘kaffarah’ for declaring or pronouncing a divorce.

Just as if all the conditions of ‘nikaah’ are fulfilled and one agrees to get married, one will be considered married…similarly if one pronounces divorce, a divorce will be established and there is absolutely no prescribed ‘kaffarah’ or atonement for pronouncing divorce.

We sincerely apologize if we have misunderstood your question and the answer is not to your satisfaction. If you need further clarification, we humbly ask you to please rephrase the question or clarify the exact situation, and if Allah Helps us, we will try to the best of our ability to give you our opinion in light of the guidance of the Quran and the Sunnah, Insha Allah.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
