Answer:

 

Can a muslim inherit from Non-Muslim?

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

All the scholars and jurists in Islam are unanimous that a ‘kaafir’ cannot inherit from a muslim. Thus, if a son, who is born of muslim parents, openly declares disbelief in Allah and the Last Day, he will not inherit any share from his muslim parents.

 

But there is a difference of opinion amongst the scholars regarding a muslim’s inheritance from ‘kaafir’ parents. They are a few who prohibit it, but the majority of the scholars in Islam are of the opinion that there is no harm in inheriting from non-muslim parents.

 

Thus if your wife is a revert to Islam, and her non-muslim family wants to leave her some inheritance, there is no harm and no sin on her in accepting it.
