Inheritence distribution

Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

 As salam Alaikum,
Plz provide me the correct question as per the hadis and sunnah.
My uncle died 13 years ago and left one wife and 2 sons age 6 and 9 years respectively.
Now at this point of time the younger son is pursuing engineering and elder one got derailed.Having habbit of drink and other toxicants.Now he starts abusing his mother and asking for money and share of property.
Pls guide us as to the distribution share of all three.
 
Keeping in view that the elder son is committing Haram acts and going astray day by day.And other family members are taking advantage of this situation as no body wishes good for her.

Answer:

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Sister the sons have become adults and they are entitled by Shariah to receive their inheritance. The distributions as per the law should be as follows:-


12.5%      to be received by the wife.
43.75%    to be received by son No. 1
43.75%    to be received by son No. 2

It is very sad that one son has taken up evil habits. He will eventually pay for his arrogance and dis-obedience to his mother, but his inheritance cannot be refused him.
