Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

Aslam-o-alaikum,

In the name of Allah, who is merciful and most beneficial to us.
There is property dispute araised by my Father.
My mother has died some years ago and my grand father ( Father of my mohter ) had died before my mother's death.
My Father is demanding the inheritence from the brothers of my mother although my mother never demanded it in her life not she gave any statement about it.

Is my Father right in demanding the inheritence of my mother although the children are not willing ? Is son-in-law has any share in his Father-in-law's property ?
Who will be the legal claimer of property of my mother ?

(There may be some grammatical and spelling errors in the above statement. The forum does not change anything from questions, comments and statements received from our readers for circulation in confidentiality.)

Answer:

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Your mother is entitled to her deceased father's property according to the laws laid down in the Quran by Allah swt.. The distribution will depend on how many of the heirs are living.

Your father will get only 25% from your mothers inheritance. The balance is to be shared between the children of your mother. This again has to be distributed as per the laws of the Quran. It will depend on how many sons and daughters she had.
