As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

I need guidance regarding my family issue. My husband`s elder brother married a non muslim by registered marriage and she is still a non muslim. My husband is not pleased with this and he is not interested in any sort of contact with his brother. But in laws are not bothered if she is not muslim, they want my husband to be in touch with his elder brother. I seek guidance of Allah, how to behave in this situation.

Answer:

Break relationship as brother in law married non muslim

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

My husband`s elder brother married a non muslim by registered marriage and she is still a non muslim.

Allah Says in the Holy Quran Chapter 2 Surah Baqarah verse 221:

Do not marry unbelieving women (idolaters) until they believe; a slave woman who believes is better than an unbelieving woman even though she allure you. Nor marry (your girls) to unbelievers until they believe: a man slave who believes is better than un unbeliever even though he allure you. Unbelievers do (but) beckon you to the fire. But Allah beckons by His grace to the Garden (of Bliss) and forgiveness and makes His Signs clear to mankind: that they may celebrate His praise.

It is absolutely and categorically prohibited for a believing man to seek to marry any but a believer in Shariah Law. A marriage between a believing man and a disbelieving woman will be absolutely illegal, invalid, unlawful and an extremely grave sin in the Sight of Allah Subhanah.

The relationship of the believing man in such an unlawful marriage will be akin to the grave sin of zina in the Sight of Allah Subhanah; and the children resulting from such a marriage will be considered unlawful in the Sight of Shariah Law.

Allah Says in the Holy Quran Chapter 5 Surah Maidah verse 5 (part):

(Lawful unto you in marriage) are (not only) chaste women who are believers but chaste women among the People of the Book revealed before your time when ye give them their due dowers and desire chastity not lewdness nor secret intrigues.

But if your brother in law has married a Christian or a Jew then there is no sin upon him.

My husband is not pleased with this and he is not interested in any sort of contact with his brother. But in laws are not bothered if she is not muslim, they want my husband to be in touch with his elder brother. I seek guidance of Allah, how to behave in this situation.

Your husband should be commended for speaking up to sinful acts by his brother. It is your duty to obey your husband in this matter and if he wishes you not to keep any relations with them, you should oblige and refrain from all contact whatsoever.

If one trusts, obeys, and follows the guidance and commands of Allah and His Messenger (saws), one can be assured of never ever being misled; but if one believes, obeys and follows any other guidance, other than that of Allah and His Messenger (saws), one can be assured of being led astray.

Whatever written of Truth and benefit is only due to Allahs Assistance and Guidance, and whatever of error is only ones. Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,
