One of our brothers/sisters has asked this question:
Kindly advice. what is the solution of this horrible crime.??
The uncel (39) MAMA & his nephew (22, bachlor) both are working together (labour work)
Once the uncel went another town with his other colleague for painting work. He said to his nephew to lookafter his family.
Unfortunaetly the nephew & his aunt (33) mami did illicit relation during the time ,in order to that she became pregnant. she has 2 kids earlier. When uncel came to know abt his wife pregnancy, he became MAD.
Finally his wife awared him abt FACT.
Recently she has given birth to babygirl which is 100% result of that illicit relation. The uncel is very poor, ignorant and soft hearted.
He not only remained away to his wife for long long time but also due to his elder sister:s dignity n respect (on sister request),he kept this issue quite sacret even at the time of discharge from hospital ,he gave his name as a father.
The nephew is younger than his aunt n yet bachelor He is very very shamful for his wrong doing.
How to solve this problem ?. pls help n reply n pray for the innocent baby girl:s goodluck. vassalaam

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.
Your Question: How to solve this problem ?.
Allah says in the Holy Quran Chapter 17 Surah Israa verse 32:
Do not even go near zina (fornication or adultery) for it is a very indecent thing and a very evil way!
Zina (adultery) is considered amongst the gravest sins in Islam. One can only imagine the severity of the sin by the punishment Allah and His Messenger (saws) have decreed for this abomination. If one is living in an Islamic State and gets convicted in a Shariah Court of the sin of zina (adultery), the punishment prescribed by Allah and His Messenger (saws) for the life of this world is that the convict should be stoned to death!! And if the person dies without making Taubah or seeking sincere repentance for their transgression from Allah Subhanah before they meet with their appointment of death, their punishment of the Hereafter in the Just Court of Allah Subhanah would be much more severe and lasting!!
Thus first and foremost, the two people guilty of zina must immediately turn unto their Lord in taubah and seek His sincere forgiveness for their abomination.if indeed they are sincerely in seeking repentance, it is expected that they will find their Lord Forgiving and Merciful.
Whatever deeds one might have done in ones past, if one turns to Allah Subhanah in sincere Taubah and seeks forgiveness, Allah Subhanah has promised in the Holy Quran that He will forgive all the sins of such a repentant believer, even if one has committed the gravest sin of all: Shirk!
The conditions or ways to seek sincere Taubah or Repentance from the Merciful Lord are:
- One is aware that he has sinned, and feels sorry and ashamed at his sin.
- Makes a solemn covenant and promise with Allah that he will not repeat his sin again.
- Turns to Allah and seeks forgiveness, before he has met with his appointment of death.
- Is a believer and does righteous good deeds thereafter.
Allah says in the Holy Quran Chapter 39 Surah Zumur verses 53-54:
(O Prophet) say: O My servants who have wronged their own souls.Do not despair of Allahs Mercy! Surely, Allah forgives all sins. He indeed is the All Forgiving, All Merciful. Return to your Lord and submit to Him before the scourge overtakes you; for then you may get no help from anywhere.
Allah says in the Holy Quran Chapter 3 Surah Ale Imraan verse 135-136:
Allah likes such good people very much, who, if ever they commit a base deed or wrong their own soul by the commission of a sin, remember Allah instantly, and ask for forgiveness from Him for their shortcomings. For who, but Allah, can forgive sins? (And Allah loves those) who do not knowingly persist in the wrongs they did. These will be rewarded with forgiveness from Allah, and with Gardens beneath which canals flow, and they will reside therein forever! How excellent is the reward of those who do good deeds!
Allah says in the Holy Quran Chapter 25 Surah Furqaan verses 63-71:
The (true) servants of the Merciful are those who walk humbly on the earth. When the ignorant people behave insolently towards them, they say, Peace to you; (And those) who pass their nights in prostrating themselves and standing before their Lord and pray, O our Lord, save us from the torment of Hell, for its torment is killing! It is an evil abode, and an evil resting place. (And those) who, when they spend are neither extravagant, nor miserly, but keep the golden mean between the two extremes. (And those) who do not invoke any god but Allah Alone, nor kill a soul unjustly, which Allah has forbidden, nor commit adultery He who does this shall be punished for his sin, and his torment shall be doubled on the Day of Resurrection, and he shall abide in a state of ignominy; EXCEPT THE ONE WHO MAY HAVE REPENTED (AFTER THOSE SINS), AND HAVE BELIEVED AND DONE RIGHTEOUS DEEDS. For then, Allah will change his evil deeds into good deeds, and He is very Forgiving and Merciful. In fact, one who repents and does righteous deeds, returns to Allah as one rightly should!
Allah says in the Holy Quran Chapter 6 Surah Anaam verse 54:
When those come to you who believe in Our Signs, say: "Peace be on you! Your Lord had inscribed for Himself (the rule of) Mercy. Verily if any of you did evil in ignorance, and thereafter repented and amended (his conduct), Lo! He is Oft-Forgiving, Most Merciful."
Al-Tirmidhi Hadith 2357 Narrated by Abdullah ibn Mas'ud
Allah's Messenger (saws) said, "He who repents of a sin is like him who has committed no sin."
Al-Tirmidhi Hadith 2338 Narrated by Abdullah ibn Umar
Allah's Messenger (saws) said, "Allah accepts a servant's repentance (taubah) till he gives up his spirit in death."
If the zina between the two people has resulted in pregnancy, the child, although absolutely innocent and blameless for the abomination and grave sin committed by his biological parents, will be considered a child born out of wedlock in the Sight of Shariah Law. The child will be known and recognized by the name of its mother, the mother will inherit from the child, and the child will inherit from its mother.
The biological father will have absolutely no legal or moral rights or responsibility towards its illegitimate child, nor will the child be called or recognized by its biological fathers name; the child will neither inherit from its biological father, nor will the father inherit from its illegitimate child.
Allah Says in the Holy Quran Chapter 33 Surah Ahzaab verses 4-5:
4 Allah has not made for any man two hearts in his (one) body: nor has He made your wives whom ye divorce by Zihar your mothers: nor has He made your adopted sons your sons. Such is (only) your (manner of) speech by your mouths. But Allah tells (you) the Truth and He shows the (right) Way.
5 Call them (those whom you adopt) by (the names) of their fathers: that is juster in the sight of Allah; but if ye know not their father's (names call them) your Brothers in faith or your Maulas. But there is no blame on you if ye make a mistake therein: (what counts is) the intention of your hearts: and Allah is Oft-Returning Most Merciful.
The husband of the wife who committed the zina is well within his rights to adopt the illegitimate child of his wife, if indeed he wishes to do so.but it would be absolutely unlawful for the person to assign, give, or call the illegitimate child through his name. The illegitimate child will be called and recognized by the name of its mother alone.
As the legal husband of the wife who has transgressed the bounds of the Lord and committed the absolute abomination of zina, he has two lawful options in Islam:
Option-1: If the husband honestly believe that his wife committed the evil of zina in ignorance, fears Allah and His Day of Accounting, and is sincerely ashamed and repentant for her abomination of a crime.and he can bring himself to forgive her, it would be best to forgive her her sin and save the marriage.
Option-2: But if the husband sees that his wife neither fears Allah nor the Day of Judgment, nor is she ashamed nor repentant for her transgressions.and given half an opportunity she would indulge in the same transgression again; it is incumbent and obligatory upon him as a husband who sincerely fears Allah and the Last Day to immediately and permanently separate from such an impious and immoral wife through divorce. It would simply not befit the characteristic of a believing husband who sincerely fears Allah and the Last Day to agree to remain married to a woman who insists or continues to commit adultery.
