Answer:

Sex with prostitute sin

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Q-1: if a man has sex with other woman and then comes home to his wife and ask for sex what must a wife do is it accepted in islam to then refuse sex to her husband?

Beloved Sister in Islam, if one is married to a person who openly transgresses the boundaries of Allah and has sexual relations with other women to whom he is not legally married…..and the wife fears that neither is her husband repentant over his abominable crime, nor is there any sign that her husband will stop this injustice….it would be best for the wife to initiate a divorce proceedings against such an impious and evil person who neither fears Allah nor the Last Day.

But as long as the wife chooses to remain married to the person, it would be her duty to satisfy her husband’s desire whenever he were to come unto her; for it is not lawful for a believing woman who sincerely fears Allah and the Last Day to refuse the intercourse advances of her husband.

Al-Tirmidhi Hadith 3257 Narrated by Talq ibn Ali

Allah's Messenger (saws) said, "When a man calls his wife to satisfy his desire she must go to him even if she is occupied at the oven."

Sahih Al-Bukhari Hadith 4.460 Narrated by Abu Huraira

Allah's Messenger (saws) said, "If a husband calls his wife to his bed (i.e. to have sexual relation) and she refuses and causes him to sleep in anger, the Angels will curse her till morning."

Q-2: is it sin to have sex with a prostiute?

Allah says in the Holy Quran Chapter 17 Surah Israa verse 32:

Do not even go near ‘zina’ (fornication or adultery) for it is a very indecent thing and a very evil way!

Allah says in the Holy Quran Chapter 24 Surah Noor verse 2:

The woman and the man guilty of ‘zina’ (fornication), flog each one of them with a hundred stripes, and let not pity for them restrain you in regard to a matter prescribed by Allah; if indeed you believe in Allah and the Last Day! And let a section of the believers witness the punishment inflicted on them.

Regardless of what kind or type of woman one has sexual intercourse with, as long as one is not lawfully married to that woman through the sacred institution of ‘nikaah’, it would be considered ‘zina’ in the Sight of Allah Subhanah.

Zina (adultery) is considered amongst the gravest sins in Islam. One can imagine the severity of the sin by the punishment Allah and His Messenger (saws) have decreed for the crime of adultery. If one is living in an Islamic State and is convicted of the sin of zina (adultery) in a Shariah Court of Law, the punishment prescribed by Allah and His Messenger (saws) for the life of this world is that the convict should be stoned to death!! And if the adulterer dies without making Taubah or seeking sincere repentance from Allah Subhanah for his abomination, the punishment of the Hereafter in the Just Court of Allah Subhanah is even more severe and more lasting than the punishment of the world!!

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
