If after marryin a man a woman reveals her past as saying that she had two times zina with a non muslim..and she did tauba ..then what islam suggest the man to do with her. He must beat her with 160 lashes or divorce her instantly? Can a zani woman marry a man who never did zina in his life?

Answer:

 

Wife confession of past zina

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

It does not behove and befit a believer, who sincerely fears Allah and the Last Day, that when Allah Subhanah has covered and hidden the evil that has transpired in one’s past, to go around and expose it themselves!!!

 

Beloved sister, it would be prudent never ever to expose the evil one might have done in one’s past to anyone, especially after The Lord Most Gracious has concealed them Himself. It may happen that although the wife may confess the evil that transpired in her past to her husband with the best of intentions, he may be of a nature whereby he cannot bring himself to accept the truth, and that might effect not only her honor in his eyes, but it might even have a negative effect on his marital relationship with her.

 

Al-Tirmidhi Hadith 2492 Narrated by Hudhayfah

Allah's Messenger (saws) said, "It is not fitting for a believer to demean himself." On being asked how he could demean himself he (saws) replied, "By exposing himself to a calamity which he has not the capacity to endure."

 

It would be best and purest to confess the sins one might have committed or the evil that might have transpired in one’s past to none save Allah Subhanah; and never ever expose those deeds of the past which one is ashamed of to anyone in creation, especially after Allah Subhanah, in His Grace and Mercy, has concealed those deeds Himself.

 

What the person who has committed this abomination of ‘zina’ in one’s past can and must do is turn back to their Lord in ‘Taubah’ and seek sincere forgiveness for his transgression; it is expected that they will find their Lord Forgiving and Merciful.

 

Allah says in the Holy Quran Chapter 39 Surah Zumur verses 53-54:

(O Prophet) say: “O My servants who have wronged their own souls….Do not despair of Allah’s Mercy! Surely, Allah forgives all sins. He indeed is the All Forgiving, All Merciful. Return to your Lord and submit to Him before the scourge overtakes you; for then you may get no help from anywhere.”

 

Allah says in the Holy Quran Chapter 3 Surah Ale Imraan verse 135-136:

Allah likes such good people very much, who, if ever they commit a base deed or wrong their own soul by the commission of a sin, remember Allah instantly, and ask for forgiveness from Him for their shortcomings. For who, but Allah, can forgive sins? (And Allah loves those) who do not knowingly persist in the wrongs they did. These will be rewarded with forgiveness from Allah, and with Gardens beneath which canals flow, and they will reside therein forever! How excellent is the reward of those who do good deeds!

 

Allah says in the Holy Quran Chapter 6 Surah Anaam verse 54:

When those come to you who believe in Our Signs, say: "Peace be on you! Your Lord had inscribed for Himself (the rule of) Mercy. Verily if any of you did evil in ignorance, and thereafter repented and amended (his conduct), Lo! He is Oft-Forgiving, Most Merciful."

But if the wife, in her ignorance and folly, wishes to demean herself and confess or reveal her past sin of ‘zina’ to her husband….the husband has the following legal options:

  1. If the husband earnestly believes that his wife has sincerely repented for the sin she may have committed in her past, he may choose to overlook her past deeds (just as Allah Subhanah, in His Mercy, has overlooked so many of his past sins)….and live with her in peace and honor under the fear and guidance of Allah Subhanah. This option would be akin to piety and righteousness in the Sight of Allah Subhanah.
  2. If the husband cannot bring himself to overlook or forgive the past deeds of his wife when he is made aware of them, and he fears he might not be able to live with his wife in peace, nor give her the honor that she deserves…..he has the option to separate himself from his wife through divorce.

 

Allah Says in the Holy Quran Chapter 24 Surah Noor verse 2:

2 The woman and the man guilty of ‘zina’ (fornication) flog each of them with a hundred stripes: let not compassion move you in their case in a matter prescribed by Allah if ye believe in Allah and the Last Day: and let a party of the believers witness their punishment.

 

Under absolutely no circumstances does the husband (or any individual) have the right to beat the wife with 1-lash (leave alone 160 lashes!!!), just because the wife has confessed her past deed of ‘zina’! The prescribed punishment of 100-lashes can only be prescribed by a Judge of a Shariah Court of Law, only when one’s case is brought to court and the guilty party is convicted of the crime of ‘zina’ (fornication) in a Court of Shariah Law. The prescribed punishments of Allah in Shariah are not something an individual can give another himself…..but rather these prescribed punishments of Allah can only be prescribed and extracted by the appointed Judge of a Shariah Court in an Islamic State.

 

Your Question: Can a zani woman marry a man who never did zina in his life? 

Allah Says in the Holy Quran Chapter 5 Surah Maidah verse 5:

5 This day are (all) things good and pure made lawful unto you. The food of the People of the Book is lawful unto you and yours is lawful unto them. (Lawful unto you in marriage) are (not only) chaste women who are believers but chaste women among the People of the Book revealed before your time when ye give them their due dowers and desire chastity not lewdness nor secret intrigues. If anyone rejects faith fruitless is his work and in the Hereafter he will be in the ranks of those who have lost (all spiritual good).

 

Allah Subhanah has explicitly Commanded and Permitted the believers to marry only chaste women from amongst the believers, or from amongst the People of the Book.

 

Allah Says in the Holy Quran Chapter 24 Surah Noor verse 3:

3 Let no man guilty of ‘zina’ (adultery or fornication) marry any but a woman similarly guilty or an unbeliever; nor let any but such a man or an unbeliever marry such a woman: to the believers such a thing is forbidden.

 

It is absolutely forbidden for a believer, who sincerely believes in Allah and the Last Day, to knowingly marry an unchaste woman, or a woman whom he knows has or is involved in the heinous crime of ‘zina’.

 

But if one who has committed ‘zina’ in one’s past, and thereafter turned back to their Lord and sought sincere forgiveness for their abomination….it is expected that their Lord Most Merciful will accept their sincere ‘taubah’ and will wipe out their sin; a marriage to such repentant believers would be lawful in Shariah.

Allah's Messenger (saws) said, "He who repents of a sin is like him who has committed no sin."

 

A woman (or man) who committed ‘zina’ in one’s past, and thereafter turned back to their Lord and sought sincere repentance is like one who had never committed the crime….for the Lord Most Merciful would completely blot out that evil from their book of records. Thus the marriage between the believer who repented and the believer who never committed ‘zina’ would be lawful in the Sight of Allah Subhanah.

 

But if the woman (or the man) who committed the crime of ‘zina’ in their past, and did not sincerely repent for their sin….it would not be lawful for a believing man (or woman) to seek such an unchaste person in marriage.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone. Allah Alone Knows Best and He is the Only Source of Strength.
