Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and
Blessings be upon all of you)
One
of our brothers/sisters has asked this question:
DEAR BURHAN, WILL YOU PLEASE
LET ME KNOW AS SOON AS POSSIBLE ARE COUPLES ALLOWED TO HAVE SEXUAL INTERCOURSE
WHEN THEY ARE ENGAGED THAK YOU
(There may be some
grammatical and spelling errors in the above statement. The forum does not
change anything from questions, comments and statements received from our
readers for circulation in confidentiality.)
Answer:
Sex when engaged
In the name of Allah, We praise Him, seek His help and ask
for His forgiveness. Whoever Allah guides none can misguide, and whoever
He allows to fall astray, none can guide them aright. We bear witness that
there is no one (no idol, no person, no
grave, no prophet, no imam, no dai,
nobody!) worthy of worship but Allah Alone, and we bear witness that
Muhammad (saws) is His slave-servant and the seal of His Messengers.
Dear and Beloved Sister in Islam, engagement or a commitment between a man and a woman to marry has absolutely no legal basis or role in Shariah; unless and until the actual ‘Nikaah’ is performed where in presence of two witnesses and the guardian of the bride, the groom proposes to marry the woman for a determined amount of ‘mehr’, and the bride accepts his proposal.
Only after the ‘Nikaah’ contract is completed, will the man and the woman be husband and wife, and permitted to conjugate with each other.
The ‘engagement’ as we know it today has absolutely no legal basis or role in Shariah, and it would be absolutely illegal and a grave sin in the sight of Allah Subhanah if the man and woman were to have sexual intercourse before their ‘nikaah’.
Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me. Allah Alone Knows Best and He is the Only Source of Strength.
Your
Brother in Islam,
Burhan
