Brother's In Islam Assalam-o-Aliekum,

you still haven't replied to my first question. IS THERE A THING CALLED ILLIGITEMATE IN ISLAM? If a couple had sex before marraige and have the baby after the marraige, will he be called ILLIGTIMATE or NOT. What is the SIN on the husband and wife, 10 lashes each, since they weren't married when they had sex and the women conceived the baby.

Illegitimate child

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person, no grave, no prophet, no imam, no dai, nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad(saws) is His slave-servant and the seal of His Messengers.

 

Q-1: IS THERE A THING CALLED ILLIGITEMATE IN ISLAM? If a couple had sex before marraige and have the baby after the marraige, will he be called ILLIGTIMATE or NOT.

If a couple who are not married when they conjugate, and they bear a child before or after marriage; they would have indeed brought an illegitimate child. The burden of the sin will be completely and absolutely borne by the parents of the child; and the child will be considered absolutely innocent, free of any guilt, or any sin whatsoever. He will be respected and honored as a human being and will be recognized by his own deeds; he will not be discriminated upon by the society in the least for what his parents have done.

 

Q-2: What is the SIN on the husband and wife, 10 lashes each, since they weren't married when they had sex and the women conceived the baby.

If the man and the woman are both unmarried when they conjugated with each other; they will be guilty in the sight of Allah Subhanah and Shariah of the grave and heinous sin of ‘zina’ or fornication.

 

If the case was brought to an Islamic Court in an Islamic State, and the man and/or the woman were convicted of the sin of fornication by a self-confession, or if the prosecution was able to produce four eye-witnesses to the ‘actual’ act of conjugation (not circumstantial evidence!), the prescribed punishment in the Holy Quran for the convicted individuals would be hundred lashes in public.

 

Allah Says in the Holy Quran Chapter 2 Surah Nur verse 2: The woman and the man guilty of ‘zina’ (fornication) flog each of them with a hundred stripes: let not compassion move you in their case in a matter prescribed by Allah if ye believe in Allah and the Last Day: and let a party of the Believers witness their punishment.

 

But if the guilty ones reside in a land not governed by Shariah, and subsequently after the sin they sincerely sought repentance and forgiveness for their sin from the Merciful Lord; they would find Allah Merciful and Forgiving.

 

Allah says in the Holy Quran Chapter 6 Surah Anaam verse 54:When those come to you who believe in Our Signs, say: "Peace be on you! Your Lord had inscribed for Himself (the rule of) Mercy. Verily if any of you did evil in ignorance, and thereafter repented and amended (his conduct), Lo! He is Oft-Forgiving, Most Merciful."

 

Allah says in the Holy Quran Chapter 39 Surah Zumur verses 53-54:(O Prophet) say: “O My servants who have wronged their own souls….Do not despair of Allah’s Mercy! Surely, Allah forgives all sins. He indeed is the All Forgiving, All Merciful. Return to your Lord and submit to Him before the scourge overtakes you; for then you may get no help from anywhere.”

 

Regardless of whether they received punishment in the world or not, if the ones guilty of fornication or adultery depart the world in a state where they have not subsequently sought sincere forgiveness from Allah Subhanah for their grave sin of ‘zina’; they will have a severe accounting in the Presence of the All-Just Lord on an Inevitable Day!

 

Allah Says in the Holy Quran Chapter 25 Surah Furqan verses 68-71:

68 (The true servants of the Merciful are) Those who invoke not with Allah any other god, nor slay such life as Allah has made sacred except for just cause, nor commit ‘zina’ ; and any that does this (not only) meets punishment

69 (But) the Penalty on the Day of Judgment will be doubled to him and he will dwell therein in ignominy.

70 Unless he repents, believes and works righteous deeds; for Allah will then change the evil of such persons into good; and Allah is Oft-Forgiving Most Merciful.

71 And whoever repents and does good has truly turned to Allah with an (acceptable) conversion

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me. Allah Alone Knows Best and He is the Only Source of Strength.
